Intellectual Property Policy

Intellectual Property Policy

ChanceScout provides a technology infrastructure platform that enables connections between athletes and football industry professionals, such as clubs and universities, through the sharing of videos selected by the athletes themselves. These videos allow football professionals to assess each player’s performance (the “Platform”).

ChanceScout does not allow content to be published on the Platform that infringes upon third-party intellectual property rights, including copyrights, trademarks, or any other rights.

This policy aims to provide information about intellectual property rights and establish the procedure for submitting a notification if you identify or suspect an infringement of intellectual property rights.

1. Intellectual Property Rights

Intellectual property rights are designed to protect creations, ensuring their creators are recognized for the use of their works, inventions, trademarks, and other assets. These rights are essential for fostering innovation, creativity, and economic development. For this reason, ChanceScout is committed to upholding and protecting these rights.

Examples of intellectual property rights include copyrights and trademark rights. Copyrights protect videos, images, music, and other audiovisual content. Trademark rights refer to the protection of names, logos, and other distinctive signs that may appear in generated content.

To safeguard these rights, ChanceScout has implemented a specific process for submitting notifications regarding content published by our users that may infringe upon third-party intellectual property rights.

2. Notification of Intellectual Property Infringement

If you are the owner of the intellectual property rights or an authorized representative of the rights holder, and you believe that any content on the Platform infringes your intellectual property rights or that your work has been copied in a way that constitutes infringement, you may submit a notification to privacidade@chancescout.com , following the requirements outlined below.

Your intellectual property infringement notification must include the following information:

  • A description of the type and nature of the allegedly infringed rights, the registration certificate (if applicable), and proof of ownership of the rights;

  • The link to the Platform content that you claim infringes your rights, or, if no specific link is available, sufficient details to help us locate the content;

  • Your contact information, including full name, address, phone number, and email address;

  • A statement declaring that: (i) the information in your notification is accurate; (ii) you are the owner of the intellectual property rights or are authorized to act on behalf of the rights holder; and (iii) you believe in good faith that the content violates intellectual property rights; and

  • A physical or electronic signature of the owner or representative of the allegedly infringed intellectual property rights.

3. Notification Review Process

Only notifications of intellectual property infringement sent through the appropriate channel (as described above) and containing all required information will be processed and reviewed by ChanceScout. This is the sole official channel for handling such cases. Notifications sent to any other channel will not be processed.

We will review your notification and may request additional information or determine appropriate actions to address any alleged infringement.

We reserve the right to send a written communication to the user who published the content mentioned in the notification and/or take other reasonable steps to inform the user that a notification regarding a potential intellectual property rights violation has been received.

It is also our policy, under appropriate circumstances and at our discretion, to disable and/or terminate user accounts that repeatedly infringe on third-party intellectual property rights.

4. User Counter-Notification

If a user receives a communication regarding an alleged intellectual property infringement, has their content suspended, or has their account temporarily suspended or terminated, and the user is the legitimate owner of the intellectual property rights or has been authorized by the rights holder, the user may contact ChanceScout through privacidade@chancescout.com  with the following information:

  • Your contact information, including full name, address, phone number, and email address;

  • A copy of the intellectual property registration certificate (if applicable) and proof of ownership of the rights; and

  • A statement declaring that you believe in good faith that the content in question does not infringe third-party intellectual property rights.

It’s important to note that even if a user is unaware of the infringement, we may still take appropriate action to address the violation.
